Ovi Uvjeti uređuju korištenje mobilne aplikacije SkyTrack ChaSK za iOS („Aplikacija”) koju razvija i izdaje Artronic d.o.o., Sveti Duh 85, 10000 Zagreb, OIB 25293446999 („Artronic”, „mi”).
Pristup vam QR kodom i PIN-om izdaje poslodavac ili pružatelj usluge ChaSK („Operater”); on odgovara za račune, podršku i podatke na poslužitelju. Uvjeti Operatera uređuju uslugu, a ovi Uvjeti softver.
Artronic vam daje osobno, neisključivo, neprenosivo i opozivo pravo korištenja Aplikacije na uređajima kojima upravljate, samo u svrhu za koju vam je Operater izdao pristup. Pristupne podatke ne smijete dijeliti. Pravo prestaje kad Operater opozove pristup ili kad ga Artronic opozove zbog povrede ovih Uvjeta.
Za primjerak preuzet iz App Storea licencu uređuje Appleov standardni ugovor o licenci za krajnjeg korisnika (Licensed Application End User License Agreement); ovi Uvjeti ga dopunjuju.
Zabranjeno je: obrnuti inženjering, osim u opsegu koji dopušta obvezno pravo; davati Aplikaciju trećima, iznajmljivati je ili prodavati; uklanjati oznake autorskih prava i žigova; slati nezakonit ili uvredljiv sadržaj; neovlašteno pristupati poslužitelju, tuđim računima ili podacima; automatizirano prikupljati podatke ili opterećivati poslužitelj.
Za sadržaj koji šaljete odgovarate vi. Neprimjeren sadržaj prijavljujete dugim pritiskom na primljenu poruku; prijavu razmatra Operater, koji korisniku koji krši ove Uvjete može ukinuti pristup.
Tahografski prikaz, ECO ocjene, automatske poruke o alarmima vozila i stanje vozila informativni su prikazi podataka koje javljaju vozilo i tahograf. Službena evidencija ostaje na tahografu, tahografskoj kartici i kod prijevoznika (Uredba (EZ) br. 561/2006, Uredba (EU) br. 165/2014).
Aplikacija, njezino ime, logotipi i izvorni kod vlasništvo su Artronica ili njegovih davatelja licence; ovi Uvjeti vlasništvo ne prenose.
Aplikacija se isporučuje „kakva jest”, bez jamstva neprekidnog rada i točnosti izvedenih izračuna. U najvećoj mjeri koju dopušta mjerodavno pravo Artronic ne odgovara za neizravnu štetu, izgubljenu dobit ili podatke ni za nedostupnost poslužitelja, mreže ili usluga trećih strana, a ukupna odgovornost ograničena je na iznos plaćen za korištenje Aplikacije u 12 mjeseci prije nastanka zahtjeva. Ograničenje ne vrijedi za štetu prouzročenu namjerno ili krajnjom nepažnjom.
Uvjete možemo izmijeniti; datum na vrhu se tada mijenja, a nastavak korištenja znači prihvaćanje izmjena. Primjenjuje se pravo Republike Hrvatske, a nadležan je sud u Zagrebu. Za pristup i podršku obratite se Operateru; za Aplikaciju i ove Uvjete: Artronic d.o.o., info@artronic.net.
These Terms govern the use of the SkyTrack ChaSK mobile app for iOS (the “App”), developed and published by Artronic d.o.o., Sveti Duh 85, 10000 Zagreb, Croatia, OIB (VAT ID) 25293446999 (“Artronic”, “we”).
Your access with a QR code and a PIN is issued by your employer or by the ChaSK service provider (the “Operator”), which is responsible for accounts, support and the data on the server. The Operator’s terms govern the service, these Terms govern the software.
Artronic grants you a personal, non-exclusive, non-transferable and revocable right to use the App on devices you control, solely for the purpose for which the Operator issued your access. You must not share your credentials. The right ends when the Operator revokes your access or when Artronic revokes it because of a breach of these Terms.
For a copy downloaded from the App Store, the licence is governed by Apple’s standard Licensed Application End User License Agreement; these Terms supplement it.
You may not: reverse-engineer the App, except to the extent permitted by mandatory law; give third parties access to the App, rent it out or sell it; remove copyright or trademark notices; send unlawful or offensive content; access the server, other people’s accounts or data without authorisation; collect data by automated means or overload the server.
You are responsible for the content you send. You report inappropriate content by long-pressing a received message; the Operator reviews the report and may revoke access for a user who breaches these Terms.
The tachograph view, ECO scores, automatic vehicle-alarm messages and vehicle status are informational displays of data reported by the vehicle and the tachograph. The official record remains on the tachograph, the tachograph card and with the carrier (Regulation (EC) No 561/2006, Regulation (EU) No 165/2014).
The App, its name, logos and source code are the property of Artronic or its licensors; these Terms transfer no ownership.
The App is provided “as is”, without a warranty of uninterrupted operation or of the accuracy of derived calculations. To the maximum extent permitted by applicable law, Artronic is not liable for indirect damage, lost profits or lost data, nor for the unavailability of the server, the network or third-party services, and its total liability is limited to the amount paid for use of the App in the 12 months before the claim arose. This limitation does not apply to damage caused intentionally or through gross negligence.
We may amend these Terms; the date at the top then changes, and continued use constitutes acceptance of the changes. The law of the Republic of Croatia applies and the court in Zagreb has jurisdiction. For access and support, contact the Operator; for the App and these Terms: Artronic d.o.o., info@artronic.net.
