Ovi Uvjeti korištenja („Uvjeti”) uređuju odnos između Artronic d.o.o., Sveti Duh 85, 10000 Zagreb, OIB 25293446999 („Artronic”, „mi”), i vas kao korisnika aplikacije SkyTrack ChaSK za Android („Aplikacija”).
Pristup vam QR kodom i PIN-om izdaje tvrtka koja za vašeg poslodavca vodi ChaSK uslugu („pružatelj usluge”); javne registracije nema. Pružatelj usluge odgovara za korisničku podršku, korisničke račune i njihovo brisanje, poslužitelj, poruke i ostale podatke na njemu te naplatu. Artronic je proizvođač i davatelj licence softvera. Kad Artronic sam vodi uslugu, ujedno je i pružatelj usluge.
Artronic vam daje osobnu, ograničenu, opozivu, neisključivu i neprenosivu licencu, bez prava podlicenciranja, za korištenje Aplikacije na uređajima kojima upravljate, isključivo u svrhu za koju vam je izdan pristup. Pristupne podatke ne smijete dijeliti ni ustupati drugima.
Licenca traje dok imate valjani pristup, poštujete ove Uvjete i pristup nije opozvan.

Neprimjeren sadržaj možete prijaviti dugim pritiskom na primljenu poruku. Prijavu razmatra pružatelj usluge, koji korisniku koji krši ove Uvjete može ukinuti pristup.
Odgovorni ste za sadržaj koji šaljete kroz Aplikaciju (poruke, fotografije, potpise, lokacije, potvrde izvršenja) i za posljedice njegova korištenja u odnosu s poslodavcem.
Tahografski prikaz (Live Tacho) je informativan izračun prema Uredbi (EZ) br. 561/2006. Službena evidencija vremena vožnje i odmora ostaje na tahografu vozila i u sustavima poslodavca.
Automatske poruke o alarmima vozila (ChaSK Bot) te stanje vozila i prikolice su informativni. Nastaju iz podataka uređaja u vozilu i stižu ovisno o tom uređaju, mreži i postavkama koje odabere pružatelj usluge; ne zamjenjuju nadzor vozila i tereta ni provjere koje propisuje zakon ili poslodavac.
Aplikacija, ime, logotipi, dizajn, izvorni kod i dokumentacija vlasništvo su Artronica ili njegovih davatelja licence. Ovi Uvjeti ne prenose vlasništvo na vas. Žigovi trećih strana pripadaju svojim vlasnicima.
Artronic može izdavati ažuriranja — sigurnosne zakrpe, nove funkcije i uklanjanje funkcija — kroz Google Play.
Aplikacija koristi servise trećih strana, primjerice Google Firebase za push obavijesti i dijagnostiku rušenja. Koji su to servisi i koje podatke primaju opisano je u Pravilima privatnosti. Artronic ne odgovara za dostupnost ni izmjene tih servisa.
Aplikacija se isporučuje „kakva jest” i „kakva je dostupna”, bez izričitih ili prešutnih jamstava, uključujući jamstva prikladnosti za određenu svrhu, točnosti izvedenih tahografskih izračuna, pravodobnosti automatskih poruka o alarmima i neprekidnog rada. Ovo ne isključuje odgovornost koja se prema obveznom pravu ne može isključiti.
U najvećoj mjeri koju dopušta mjerodavno pravo, Artronic ne odgovara za neizravnu ili posljedičnu štetu, izgubljenu dobit, izgubljene podatke ni prekid poslovanja, niti za štetu zbog nedostupnosti poslužitelja pružatelja usluge, mreže ili servisa trećih strana. Zahtjeve najprije uputite pružatelju usluge. Ukupna odgovornost Artronica ograničena je na iznos plaćen za korištenje Aplikacije (izravno ili preko pružatelja usluge) u 12 mjeseci prije nastanka zahtjeva. Ograničenje ne vrijedi za štetu prouzročenu namjerno ili krajnjom nepažnjom.
Uvjeti prestaju kad pružatelj usluge opozove vaš pristup, kad uklonite Aplikaciju ili kad Artronic opozove licencu zbog povrede Uvjeta. Nakon prestanka morate prestati koristiti Aplikaciju. Članci 5, 8, 9 i 11 vrijede i nakon prestanka.
Na ove Uvjete primjenjuje se hrvatsko pravo. Za sporove je nadležan stvarno nadležni sud u Zagrebu, osim ako obvezno pravo potrošaču daje pravo na sud prema njegovu prebivalištu. Ništa u ovim Uvjetima ne ograničava prava koja potrošač ima prema obveznom pravu.
Artronic može izmijeniti ove Uvjete. Datum stupanja na snagu mijenja se pri svakoj izmjeni, a bitne izmjene najavljujemo kroz Aplikaciju ili preko pružatelja usluge.

These Terms of Use (the “Terms”) govern the relationship between Artronic d.o.o., Sveti Duh 85, 10000 Zagreb, Croatia, VAT ID HR 25293446999 (“Artronic”, “we”), and you as a user of the SkyTrack ChaSK app for Android (the “App”).
Your access is issued with a QR code and a PIN by the company that runs the ChaSK service for your employer (the “service provider”); there is no public sign-up. The service provider is responsible for user support, user accounts and their deletion, the server, the messages and other data on it, and billing. Artronic is the software manufacturer and licensor. When Artronic runs the service itself, it is also the service provider.
Artronic grants you a personal, limited, revocable, non-exclusive and non-transferable licence, without the right to sublicense, to use the App on devices you control, solely for the purpose for which your access was issued. You must not share your credentials or transfer them to others.
The licence lasts as long as you have valid access, comply with these Terms and your access has not been revoked.
You may not:
You can report inappropriate content by long-pressing a received message. The service provider reviews the report and may revoke access for a user who breaches these Terms.
You are responsible for the content you send through the App (messages, photos, signatures, locations, task confirmations) and for the consequences of its use in your relationship with your employer.
The tachograph view (Live Tacho) is an informational calculation under Regulation (EC) No 561/2006. The official record of driving and rest times remains on the vehicle’s tachograph and in the employer’s systems.
Automatic vehicle-alarm messages (ChaSK Bot) and the status of the vehicle and trailer are informational. They come from the units in the vehicle and arrive depending on those units, the network and the settings chosen by the service provider; they do not replace monitoring of the vehicle and cargo or checks required by law or by the employer.
The App, its name, logos, design, source code and documentation are the property of Artronic or its licensors. These Terms do not transfer ownership to you. Third-party trademarks belong to their owners.
Artronic may release updates — security patches, new features and removal of features — through Google Play.
The App uses third-party services, for example Google Firebase for push notifications and crash diagnostics. Which services these are and what data they receive is described in the Privacy Policy. Artronic is not responsible for the availability of or changes to those services.
The App is provided “as is” and “as available”, without express or implied warranties, including warranties of fitness for a particular purpose, accuracy of derived tachograph calculations, timeliness of automatic alarm messages and uninterrupted operation. This does not exclude liability that cannot be excluded under mandatory law.
To the maximum extent permitted by applicable law, Artronic is not liable for indirect or consequential damage, lost profits, lost data or business interruption, nor for damage caused by the unavailability of the service provider’s server, the network or third-party services. Direct claims to the service provider first. Artronic’s total liability is limited to the amount paid for use of the App (directly or through the service provider) in the 12 months before the claim arose. This limitation does not apply to damage caused intentionally or through gross negligence.
These Terms end when the service provider revokes your access, when you remove the App, or when Artronic revokes the licence because of a breach. After termination you must stop using the App. Sections 5, 8, 9 and 11 survive termination.
These Terms are governed by Croatian law. The competent court in Zagreb has jurisdiction, unless mandatory law entitles a consumer to the court of their place of residence. Nothing in these Terms limits the rights a consumer has under mandatory law.
Artronic may amend these Terms. The effective date changes with every amendment, and material changes are announced in the App or through the service provider.
